Use of Your Information

General. We use the information we collect from you on this Site primarily to enable us to effectively provide our products and services, including:

  • To provide you the information, products or services offered on or through this Site;

How Do We Share Personal Data?

Lightspeed provides personal data to third parties only with consent or in one of the following circumstances (subject to your prior consent where required under applicable law):

Vendors: Lightspeed works with third-party service providers to provide, support, and improve Lightspeed products and services and technical infrastructure, and for business services such as payment processing. These vendors can access personal data subject to contractual and technical requirements for protecting personal data and prohibiting them from using personal data for any purpose other than to provide services to Lightspeed or as required by law.

For Legal Reasons: Lightspeed may share personal data as needed to: (1) comply with applicable law or respond to, investigate, or participate in valid legal process and proceedings, including from law enforcement or government agencies; (2) enforce or investigate potential violations of its Terms of Service or policies; (3) detect, prevent, or investigate potential fraud, abuse, or safety and security concerns, including threats to the public; (4) meet our corporate and social responsibility commitments; (5) protect our and our customers’ rights and property; and (6) resolve disputes and enforce agreements.

Marketing, Advertising, and Analytics Partners: Lightspeed uses third-party marketing, advertising, and analytics providers: to provide statistics and analysis about how people are using Lightspeed products and services, including our website; and to provide advertising and marketing for Lightspeed products and services, including targeted advertising based on your use of our website. These third-party partners may receive information about your activities on Lightspeed’s website through third-party cookies placed on Lightspeed’s website. Where required by law, Lightspeed will first obtain your consent before engaging in the marketing or advertising activities described.

Change of Control: We may share personal data with actual or prospective acquirers, their representatives and other relevant participants in, or during negotiations of, any sale, merger, acquisition, restructuring, or change in control involving all or a portion of Lightspeed’s business or assets, including in connection with bankruptcy or similar proceedings.

Third-Party Developers: If you purchase a third-party app or integration, Lightspeed may share information about the purchase with the third-party developer, to provide the app or integration.

Security

We use commercially reasonable physical, electronic, and managerial procedures to safeguard and secure the information we collect on this Site. These procedures may include, but are not limited to, facility access control, firewalls, encryption, intrusion detection, and Site monitoring. However, no data protection procedures are entirely infallible. As a result, while we strive to protect your personally identifiable information, we cannot guarantee that it will be 100% secure. Your transmission of your data to this Site is done entirely at your own risk.

Third-Party Websites and Social Media Features

This Site may contain links to third-party websites (“Linked Site”). Lightspeed provides these Linked Sites solely for your convenience and does not control or endorse any of them. Lightspeed cannot be responsible for the content, security, or privacy policies of such Linked Sites. By accessing other third-party websites or applications through this Site, you are consenting to the terms and privacy policies of those websites. It is possible that other parties may collect personally identifiable information about your online activities over time and across different websites when you use Lightspeed’s Site.

Our Site may include social media features, such as the Facebook “Like” button. These features may collect your IP address and the website pages you are visiting and may set a cookie to enable the feature to function properly. Social media features are either hosted on a third-party website or hosted directly on this Site. Your interactions with these features are governed by the privacy statement of the entity providing them.

International Visitors

This Site is hosted and operated in the United States (“US”) and elsewhere in the world except Europe. It is not intended to be used by users in, or to offer products or services to, residents of, Europe. By using the Site, you are consenting to the transfer of any information related to your use of this Site (including your personal information) to the US or to another jurisdiction other than your own. Lightspeed provides services to auto, truck, motorcycle, recreational and heavy equipment dealers around the world. As a service provider, we only collect and use personal information as authorized by our contracts with our clients. To exercise your privacy rights, please contact the dealerships or the businesses with whom you have relationships. These companies can authenticate you and provide information about the rights that you may have under CCPA or other applicable laws.

Lightspeed does collect contact information from commercial customers and business professionals that will be subject to the CCPA in January 2021. We do not sell this personal information, but we may share business customer information with our affiliates and service providers. We may also disclose personal information to third parties for business purposes as permitted by the CCPA, such as to our auditors, for compliance or security, or in connection with mergers and acquisitions, or with consent.

We also offer visitors to our websites to manage their choices regarding data collected and shared via cookies using our Cookie Consent Tool.

Children’s Privacy

This Site is solely for use by businesses and by people who are at least 18 years old. By using this Site, you affirm that you are at least 18 years of age. We are not liable for any damages that may result from a user’s misrepresentation of age. Under no circumstances may anyone under 13 years of age use this Site, or submit any information, including personally identifying information, on this Site. Parents or legal guardians of children under the age of 13 cannot agree to these terms on their behalf in order to overwrite this paragraph.
